THESE TERMS AND CONDITIONS OF MOVEMENT TRAVEL SIGNATURE RETREATS BOOKING AND SALE (THESE “TERMS”) CONTAIN VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS, REMEDIES AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS. PLEASE READ THESE TERMS CAREFULLY.
By booking, purchasing and/or participating in a retreat or event and any related products or services (a “Retreat”) with LM Movement Travel Ltd. (referred to as “we”, “us” or “our” as the context may require), you (referred to as “you” and “your”) agree to these Terms.
You may not book, obtain or purchase any products or services offered on or through www.movementtravel.com (this “Site”) if you: (i) do not agree to these Terms; (ii) are not the older of (a) at least 19 years of age, or (b) legal age to form a binding contract with us; or (iii) are prohibited from accessing or using this Site or any of this Site’s contents, products or services by applicable law.
These Terms are subject to change by us without prior written notice at any time, in our sole discretion. Any changes to these Terms will be in effect as of the “Last Updated Date” referenced on this Site. You should review these Terms prior to booking and purchasing any products and/or services that are available through this Site. Your continued use of this Site after the “Last Updated Date” will constitute your acceptance of, and agreement to, such changes.
These Terms are an integral part of the Website Terms and Conditions of Use https://www.movementtravel.com/website-terms-conditions/ that apply generally to the use of this Site. You should also carefully review our Privacy Policy https://www.movementtravel.com/privacy-policy/ before placing a booking through this Site. Our Privacy Policy governs the processing of all personal data collected from you in connection with your booking and purchase of products and/or services through this Site.
In completing and submitting an online registration (a “Booking”) for a Retreat through this Site, you acknowledge that you have read, understand and agree to be bound by these Terms. These Terms together with our Privacy Policy, our Website Terms and Conditions of Use, and any other written information we brought to your attention before we confirmed your Booking, form the basis of your contract with us.
1. Booking
a. To book and purchase a Retreat, you must complete and submit a Booking together with a non-refundable deposit or payment in full, which will be specific to your Booking. You agree that your Booking is an offer to buy, under these Terms, all of the products and services listed in your Booking. You affirm that if you make a Booking on behalf of other participants (whether an individual(s), organization, company or other entity whatsoever), you guarantee that you have the legal authority to accept and bind, and do hereby accept and bind, these Terms on behalf of such other participants in your Booking. Furthermore, you consent to our use of your personal data in accordance with our Privacy Policy and you affirm that you are authorized on behalf of all participants in your Booking to disclose their personal information to us, including where applicable, special details (such as information on health conditions or disabilities). You agree to provide true, complete, and accurate information to us.
b. All Bookings must be accepted by us or we will not be obligated to sell the Retreat to you. Your Booking is confirmed, and a contract exists when we send a Booking confirmation email with an invoice after receipt of the applicable deposit or required payment Please check your invoice carefully and report any incorrect or incomplete information to us immediately. Please ensure that names are exactly as stated in the relevant passports.
c. By placing a Booking on behalf of any other participants, you are deemed to be the designated contact person for every participant included in that Booking, and you are responsible for making all payments due in connection with that Booking, notifying us of any changes or cancellations, and keeping the other participants
d. By placing a Booking on behalf of any other participants, you represent and warrant that you have obtained all necessary and required consents. You are responsible for verifying that any information you provide on behalf of another participant is true, complete and accurate and we will not be liable or responsible for any errors or omissions in the information provided to complete a B
2. Prices and Payment Terms
a. All prices, discounts, and promotions posted on this Site are subject to change without notice. The price charged for a Retreat will be the price advertised on this Site at the time the Booking is placed, subject to the terms of any promotions or discounts that may be applicable. All prices on this Site in relation to the Retreat are quoted in US dollars. The price charged will be stated in your invoice. Price increases will only apply to Bookings placed after the time of the increase. Retreats are priced and advertised on our Site inclusive of applicable taxes. Any additional charges will be added to your total price and will be itemized in your invoice. We strive to display accurate price information; however, we may, on occasion, make inadvertent typographical errors, inaccuracies or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any Booking arising from such occurrences.
b. Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before our acceptance of a Booking. We accept most major credit cards in US dollars. You represent and warrant that: (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes and shipping and handling charges, if any, regardless of the amount quoted on this Site at the time of your booking.
c. At the time of booking, a non-refundable deposit is required to book a Retreat. We will advise you of the applicable deposit amount on the Site. One hundred percent (100%) of the Retreat price is due on or before June 1, 2025 and is non-refundable and non-creditable at that time. If the Booking is made after June 1, 2025, full payment of the Retreat price is due at the time of booking and is non-refundable and non-creditable.
d. If we do not receive the deposit or balance of payment for the Retreat by the required payment dates, it will be deemed that you will not be participating in the Retreat and cancellation charges in accordance with Section 9(a) of these Terms will apply.
e. You represent and warrant that you are buying products or services from this Site for your own use only and not for resale or export.
3. Items Not Included in Retreats
a. Retreat prices do not include any airfare. At your request, we will arrange airline travel to the location of the Retreat for an additional service fee outlined in our General Terms & Conditions of Booking & Sale found here – https://www.movementtravel.com/general-terms-conditions-booking-sale/. If you do not request Movement Travel’s assistance, you must secure your own airline travel to the location of the Retreat. Air cancellation charges, if any, will be assessed in accordance with airline regulations. Please consult the air carrier’s applicable terms and conditions and conditions of carriage for complete information including applicable cancellation terms. You acknowledge and agree that neither we nor our accompanying Retreat guide or instructor (“Guide”) shall be responsible or liable for any airline changes, cancellation, or charges or penalties incurred.
b. Certain other items are not included in the price of the Retreat. These costs which are your responsibility include, in addition to air travel, optional meals and drinks, optional excursions or add-on activities, on-location Retreat activities not reflected in the Booking, as well as expenses and incidental charges of a personal nature, including without limitation, laundry, alcohol and shopping. Upon check-in at the hotel, you will be required to provide a personal credit card for your hotel room and are responsible for any additional charges, such as mini-bar or damage caused to the hotel room, for the entire duration of your stay. This also applies if you will be staying additional nights prior to or after the dates of the Retreat
4. Limitation of Liability and Release re Third Party Product/Service Providers
a. We act only as an agent for you with respect to arranging and/or booking transportation, accommodations, ‘optional add-ons’ and all other products or services relating to the Retreat as itemized in your Booking or Retreat itinerary, unless expressly stated otherwise in writing. LM Movement Travel Ltd., its directors, officers, employees, shareholders, affiliates, subsidiaries, successors, assigns, contractors, representatives and agents, including without limitation, the Guides (collectively, “MT Parties”) assume no responsibility or liability whatsoever of any third party, including without limitation any liability for any act, error or omission, or for any injury, loss, cost, expense, damage, accident, death, delay or irregularity that may be occasioned by reason of any defect in any aircraft, ship, train, bus or other carrier, or through neglect or default of any agent, subcontractor or other third party, which may be used wholly or in part in the performance of their duty to you of the Retreat. The passage ticket issued by the carrier is the sole contract between you and the carrier. None of MT Parties are responsible for transportation or other Retreat delays and changes, nor additional expenses or loss of time that may be incurred.
b. Unless expressly stated otherwise in writing, you understand that none of the MT Parties, owns or operates any entity which provides goods or services for your Retreat including, without limitation, lodging facilities, transportation companies, food service providers, equipment suppliers or any other third party product and/or service provider. You hereby agree to accept responsibility for your own welfare and you accept any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma or death, or acts of God/force majeure. You hereby release and discharge each of the MT Parties from and against any and all liabilities from activities undertaken by you in connection with the Retreat.
c. In the event it becomes necessary or advisable for your comfort or well-being, or for any reason whatsoever, to alter the Retreat itinerary at any time, without notice to you, such alterations will be made without penalty to any of the MT Parties. Additional expenses, if any, shall be borne by you. Baggage and personal effects are your sole responsibility at all times. We and Guides reserve the right to accept or decline you as a participant in a Retreat at any time, or to require you to withdraw from the Retreat at your own expense when such an action is determined by us or a Guide to be in the best interest of your health and safety, or the general welfare of the other participants of the Retreat.
5. Passport, Visa, and Health Regulations
a. You are responsible for compliance with any passport, visa, and health regulations valid in the Retreat country. It is strongly advised that you travel with a passport that has greater than six (6) months’ time to the expiration date. You are liable for any damages resulting from your failure to comply with any of the above regulations and/or not being permitted into a country due to insufficient time remaining to expiry on your passport. b. You are responsible for the fulfillment of other requirements, and in particular health requirements, enabling you to participate in the Retreat without any damage to your health and the other participants of the Retreat.
6. Health Requirements and Assumption of Risks
a. You acknowledge that wellness, adventure and special interest travel and the products and services offered by us may involve a significant amount of risk and danger to your health and safety. You must be in good physical and mental health to participate in any Retreat. A Retreat may take place in areas where there is little or no access to normal medical services or hospital or medical facilities for serious problems. Medical and evacuation expenses will be your responsibility, and you may be required to send proof to us of sufficient travel medical insurance at least thirty (30) days prior to the Retreat. We reserve the right in our sole and absolute discretion to refuse you the right to participate in a Retreat on medical or fitness grounds.
b. You acknowledge that: (i) by the very nature of the Retreat, such tours or activities may be more challenging and demanding with a commensurately significant degree of personal risk and danger involved in participating, compared with conventional retreats, tours and activities, and may involve potential exposure to injury and in the countries and regions in which the Retreat is undertaken, standards of accommodation, transport, health care, hygiene, safety and service provision may not be as high as those standards in your country of residence and may require flexibility and patience on your part; (ii) the Retreat may involve travel and visiting to remote or developing regions, where medical care may not be easily accessible; (iii) the condition of medical facilities in the countries you may visit on the Retreat varies and we make no representations and give no warranties in relation to the availability or standard of medical facilities in those regions; (iv) operational control of the Retreat may be in the hands of a third party and that your right of action in regard to any shortcomings of that third party’s performance is against the third party and not against any of the MT Parties; and (v) the enjoyment and excitement of the Retreat may be derived in part from the inherent dangers and risks associated with wellness, adventure and special interest travel and that those inherent dangers and risks are a reason why you wish to undertake and participate in the Retreat.
c. You must be medically fit, in good health and able to participate in the Retreat. If you have any pre-existing medical condition or illness, you must disclose to us the nature of any such condition at the time you submit your Booking and make arrangements for the provision of any medication or other cause of treatment, which may be required during the Retreat at your own cost and expense. We may request that you provide us with proof of sufficient travel medical insurance coverage prior to us accepting you as a participant on a Retreat. We do not accept any responsibility whatsoever for you being refused entry to any country due to incomplete health documentation or vaccinations.
d. You must provide certain traveler information and details, emergency contact information and medical information reasonably requested by us by completing our registration form (the “Questionnaire”) when you submit your Booking for the Retreat.
e. Your completion and submission of the Questionnaire is mandatory for Retreats. If you have any pre-existing medical condition or illness which may impact your ability to travel, participate in a Retreat, travel to remote areas with limited or no access to medical facilities, or may adversely affect the experience of other participants on a Retreat, we may require that you provide a medical certificate of fitness for travel and participation in a Retreat signed by a licensed and practicing physician to us prior to the start date of the applicable Retreat.
f. You agree to complete the Questionnaire truthfully and to disclose all relevant information accurately and completely. We will maintain the information in accordance with our Privacy Policy.
g. We reserve the right to request further information or professional medical opinions where necessary, as determined in our sole discretion, for your safety, the safety of other participants, and/or the safe administration and operation of a Retreat.
h. We reserve the right to deny you permission to travel or participate in a Retreat or any activity or aspect thereof at any time and at your own risk, cost and expense, where we determine in our sole discretion that your physical or mental condition renders you unfit for travel or participation, or you represent a danger to yourself or others.
i. In the event that you do not complete the required Questionnaire or provide information reasonably required by us for any reason by our required deadline, we reserve the right to cancel your Booking without liability or responsibility to you and the cancellation charges in Section 9(a) of these Terms will apply.
j. You are responsible for assessing whether a Retreat and your participation thereof is suitable for you. You should consult your physician to confirm your fitness for travel and participation in a Retreat and any related and planned activities. You should seek your physician’s advice on vaccinations and medical precautions. We do not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of a Retreat based on your own unique circumstances, limitations, fitness level, and medical requirements.
7. Special Requirements and Requests
a. You must disclose to us any special requirements or requests at the time of booking. We will use reasonable efforts to accommodate special requirements or requests, but this is not always possible given the nature of the Retreat destinations and the availability of options outside the planned Retreat itinerary. Certain activities may be inaccessible to you if your mobility is limited in any way. All food allergies and dietary restrictions must be disclosed to us at the time of booking, but we cannot guarantee that dietary needs or restrictions can be accommodated. Any special requests or requirements do not form part of these Terms or the contract between you and us and we are not liable or responsible for any failure to accommodate or fulfill such requirements or requests. All costs and expenses in regard to any special requirements or requests shall be borne by you.
b. You hereby assume responsibility for all risks set out in Sections 6 and 7 of these Terms and release each of the MT Parties from all claims, actions, causes of action, suits, proceedings, judgements, and demands arising from any and all liabilities, losses, damages or injuries or death resulting from risks inherent in travel, including wellness travel specifically, visiting foreign destinations, and participating in wellness, adventurous and special interest travel activities such as those included in our Retreat itineraries or otherwise offered by us.
c. You agree that we are not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges, or laws and regulations in effect in any locations where a Retreat is conducted. You acknowledge that you have considered the potential and inherent risks, dangers, and challenges and your own personal circumstances, capabilities and needs, and you expressly assume all risks and dangers associated with a Retreat and related travel and activities under such conditions.
d. When travelling, you should recognize and respect the social and political standard of living. This includes religion, local practices, political systems and the conditions of utilities, services and accommodations which may differ from those found in your own country of residence. We will not assume responsibility.
e. You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on a Retreat or, if in the opinion of us or a Guide, your behavior is causing or is likely to cause danger, distress or material annoyance to others, we or a Guide may terminate the Retreat or any other product or service immediately at your cost and expense and without any liability to any of the MT Parties. You will not be entitled to any refund or credit for unused or missed services or costs incurred as a result of termination of the Retreat and/or other products or services, including, without limitation, return travel, accommodations, meals, and incidentals.
f. You are responsible for any costs and expenses (including without limitation, repair, replacement, and cleaning fees) incurred by us or any of our suppliers for property damage, destruction, or theft caused by you while on a Retreat.
g. You agree to take all prudent measures in relation to your own safety while on a Retreat including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices, and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. None of the MT Parties are liable for losses or damages caused by your failure to comply with safety requirements, instructions or warnings.
8. Insurance Coverage
a. You are required to purchase travel insurance covering all applicable dates of travel with regard to a Retreat which includes, but is not limited to, medical, accident and sickness, emergency evacuation and repatriation, accidental death and dismemberment, worldwide emergency assistance and any other insurance necessary for sufficient coverage during the Retreat. You are strongly recommended to extend your coverage to include trip cancellation, trip interruption, and all other costs and expenses that may arise as a result of loss, damage, injury, death, delay or inconvenience while traveling. You acknowledge that insurance coverage is not included in the cost of any Retreat and you are required to obtain separate coverage at an additional cost at your own expense. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for advising your insurer of the type of travel, destination(s) and activities included in your Booking so that the insurer may provide appropriate coverage.
b. None of the MT Parties will be responsible for any loss, injury, damage, cost or expense to persons resulting from insufficient insurance coverage.
c. Questions concerning specific coverage must be addressed directly to the insurance/protection provider. We shall not in any way be held responsible for any and/or all information provided by insurance/protector providers employees and/or agents in this regard.
9. Cancellations and Refunds
a. We must strictly adhere to our cancellation policy to offset costs incurred prior to the commencement of the Retreat, which may include but are not limited to: advance payments to accommodation providers, transportation companies, tour and other land operators; ship charters; communication expenses; development/promotional expenses and the loss of time that might have permitted resale of reserved space. Guides shall have no liability for refunds or credit. No refunds or credit are given for cancellation on or after the start date of a Retreat, or for any unused portions of a Retreat, for any reason. If you wish to cancel your Booking you must notify us in writing. Once we receive your written notice, cancellation will take effect subject to the following charges:
- All deposits are non-refundable.
- Before June 1, 2025: no additional penalty.
- On June 1, 2025 or after: 100% penalty; no refunds or credit will be payable.
b. We reserve the right to cancel any Retreat prior to the start date of a Retreat for any reason whatsoever including, without limitation, in the event that there are too few participants, as determined by us in our sole discretion. In the event of our cancellation of a Retreat (save and except for our cancellation due to any event described in Section 9(c) or Section 11 of these Terms) you will be given a full refund of any and all payments you made to us for the applicable Retreat, which shall constitute full settlement. Refunds will be issued by credit card refund within thirty (30) days of cancellation. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, cost, expense or damage (direct, indirect, consequential, incidental, special or otherwise) or for any loss of time or inconvenience which may result from such cancellation, including but not limited to visa, passport, vaccination charges, gear purchases, tours and excursions, and airfare and airline taxes. In the case of a cancellation due to shortage of participants, we will attempt to notify all participants at least sixty (60) days prior to the start date of the Retreat.
c. In the event we cancel any Retreat due to any government travel warning or advice, or change thereof, subject to Section 11(a) of these Terms, we will, at our option and sole discretion, without liability or responsibility to you, transfer any of your payments made for the Retreat to be applied to a future Retreat with us.
10. Changes, Substitutions, Postponements, or Delays
a. We reserve the right to make changes to any aspect of a Retreat if it is necessary to do so due to conditions that are likely to be hazardous or dangerous or due to any other adverse or threatening conditions whether political, military, terrorist or otherwise or if an act or omission of a third party prevents the Retreat or any aspect of the Retreat from being undertaken in accordance with your Booking or for any other reason considered necessary by us. If the designated Guide is unable to lead the Retreat for any reason, we, in our sole discretion will enlist another Guide to lead the Retreat. In the event of any change, modification, substitution, postponement or delay under these conditions, you acknowledge that you will have no right of refund or credit of the Retreat price (whether in whole or in part) and no right to claim compensation for any injury, loss, cost or damage (indirect, consequential, incidental, special or otherwise) or other expenses incurred by virtue of the change, modification, substitution, postponement or delay.
b. The Retreat itinerary is subject to change at the discretion of us and/or the Guide. All prices quoted are based on prevailing prices and currency exchange rates in effect at the time of any email advertising or website and social media posting and are subject to change without notice. Deviations from the scheduled Retreat itinerary of a Retreat are at your cost and expense.
c. Once a Retreat has started, Retreat itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort. Any changes are at our sole and absolute discretion. You acknowledge that you must have reasonable financial resources to cover incidental expenses during the Retreat, whether or not such expenses arise from a change of Retreat itinerary, and we are not liable for your failure to prepare adequately for travel and unforeseen circumstances which may arise during the Retreat. We will not be liable for any indirect and/or consequential losses associated with any changes to a Booking or Retreat
11. Extraordinary Circumstances and Force Majeure Incidents
a. We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms (including without limitation, for any loss or damage resulting from any delay, cancellation, loss of personal belongings, illness, bodily injury, accident, death, deterioration of travel services, inconvenience, loss of enjoyment, disappointment or frustration, either mental or physical) when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, an act of God, flood, fire, earthquake, weather conditions which make it impossible to travel safely to the Retreat destination or remain at the Retreat destination, explosion, natural or nuclear disaster, governmental or political action, war, invasion or hostilities (whether war is declared or not), terrorist threat or act, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockout, strike, or other labour dispute (whether or not relating to our workforce), or restraint or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage, interruption of transport, act or omission of a third party, and we may, at our option and sole discretion, either cancel the Retreat and/or take any other action as specified in Section 9 of these Terms.
12. Indemnification, Limitation of Liability and Complaints
a. In consideration of us accepting your Booking you release, waive, discharge, and agree to defend, indemnify and hold harmless each of the MT Parties from and against all claims, actions, causes of action, suits, proceedings, judgments, demands, damages, penalties, fines, fees, losses, costs, interest, expenses and liabilities of whatever kind, including without limitation, losses for bodily injury, pain and suffering, emotional distress, death, property loss or damage, loss of services, loss of profits, consequential, exemplary, indirect, special, liquidated, aggravated, or punitive damages or otherwise, arising out of, relating to, in connection with, resulting from or occurring during, a Retreat, your participation in a Retreat, travel in connection with a Retreat or any activities in conjunction therewith; and regardless of the situation or circumstances giving rise to the claim you waive any claims you have, or may at any time have, against any of the MT Parties and you agree, by accepting the additional inherent and potential dangers and risks associated with a Retreat, not to make any claim against or seek any compensation from any of the MT Parties in respect of any personal injury, illness or death suffered by you or damage to or loss of property sustained by you as a result of your participation in a Retreat.
b. We are not liable for any losses or damages resulting from your participation in any event, activity or other retreat, during the Retreat, not organized by us.
c. You agree to bring any complaints to us as soon as possible in order to provide us with the opportunity to properly address such complaint. We assume no liability for complaints that are not properly brought to our attention, and we cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of the Retreat must be received in writing by us within thirty (30) days of the last day of the Retreat.
13. Waiver of Recourse to the Courts and Binding Arbitration
a. You and LM Movement Travel Ltd. are agreeing to give up any rights to litigate claims in a court. Other rights that you would have if you went to court may also be unavailable or may be limited in arbitration.
b. Any claim, dispute or controversy (whether in contract, tort or otherwise, whether pre-existing, present or future, and including statutory, consumer protection, common law, intentional tort, injunctive and equitable claims) between you and us arising from or relating in any way to a Retreat or purchase of products or services through this Site, will be resolved exclusively and finally by binding arbitration.
c. In the unlikely event that a dispute arises between you and any of the MT Parties, the following conditions will apply: (a) the dispute will be settled by binding arbitration in accordance with the Commercial Arbitration Act (British Columbia); (b) the arbitration proceeding shall be brought and held in the City of Vancouver, British Columbia, Canada; (c) the arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction; and (d) the maximum amount of recovery to which you shall be entitled under any and all circumstances will be the sum of all monies actually received from you by us. You agree that this is a fair and reasonable limitation on the damages, of any sort whatsoever, that you may suffer.
d. If any provision of these arbitration terms is found unenforceable, the unenforceable provision will be severed and the remaining arbitration terms will be enforced.
14. Permission to Use Photos and Videos
a. You agree that, while participating in any Retreat, images, photos or videos may be taken by us, our representatives, Guides, or other participants of the Retreat, that may contain or feature you. By participating in a Retreat, you hereby consent and agree to any such images or recordings being taken and you hereby grant permission to us to the rights of your image, likeness and voice as recorded on audio or video tape without payment or any other consideration. You understand that your image or recording may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein your likeness appears or voice is recorded. Additionally, you hereby waive any right to royalties or other compensation arising or related to the use of your image or recording.
b. You also understand that your image or recording may be used in various publications, public affairs releases, promotional materials, educational settings or for other related endeavors unrestricted by geographic area. You grant a perpetual, royalty-free, worldwide, irrevocable license to us, our contractors, sub-contractors, successors and assigns, to reproduce such image or recording for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
c. By participating in a Retreat, you understand this permission signifies that photographic or video recordings of you may be electronically displayed via the Internet or in any public setting. This applies to photographic, audio or video recordings collected as part of any and all Retreats. You acknowledge and agree that there is no time limit on the validity of this release and waiver nor is there any geographic limitation on where these materials may be distributed.
15. General Provisions
a. Headings. The section headings of these Terms are for reference purposes only and shall not be used in the interpretation of these Terms to which they relate.
b. Governing Law and Jurisdiction. These Terms shall be governed by, construed and/or interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein and shall be treated in all respects as a British Columbia contract, without regard to principles of conflicts of law that would impose a law of another jurisdiction.
c. Assignment. We may at any time assign any of our rights and/or obligations under these Terms, in whole or in part, without notice to you. You may not assign any of your rights or delegate any of your obligations under these Terms. Any purported assignment or delegation in violation of this Section 15(c) of these Terms is null and void.
d. No Waivers. The failure or delay by us to exercise or enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of LM Movement Travel Ltd.
e. No Third-Party Beneficiaries. Save and except as expressly provided otherwise in these Terms, these Terms are for the sole benefit of each of us and you, and nothing herein, is intended to or shall confer upon any other person any legal or equitable right, benefit or remedy of any nature whatsoever, under or by reason of these Terms.
f. Notices.
(i) To You. We may provide any notice to you under these Terms by: (i) sending a message to the email address you provide to us and consent to us using; or (ii) by posting to this Site. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
(ii) To Us. To give us notice under these Terms, you must contact us by email transmission to info@movementtravel.com. We may update the email address or address for notices to us by posting a notice on this Site. Notices provided by email transmission will be effective one (1) business day after they are sent.
g. Enurement. These Terms shall enure to the benefit of and be binding upon each of you and us and our respective personal and legal representatives, successors and permitted
h. Severability. If any provision of these Terms is deemed to be invalid, illegal, void or unenforceable, then such provision shall be severed from these Terms and shall not affect the validity or enforceability of the remaining provisions of these Terms.
i. Entire Agreement. Our Booking confirmation email, these Terms, our General Terms & Conditions of Booking & Sale, our Website Terms and Conditions, our Retreat Waiver, and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.
